Child Custody And Termination of Parental Rights

In a recent case, the court of appeal held that a trial court properly terminated a father’s parental rights so that his children could be adopted by their stepfather, when sufficient evidence established, under Family Code Section 7822, that the father had left his children for one year with the intent to abandon them during that time.

Husband and Wife were married in 1991 and had three children. In March 2000, Jill sought a legal separation in Yolo County alleging that she and the children left the family home to escape Father’s instability and violence. In July when Husband failed to appear at a family court hearing, the family court awarded legal and physical child custody to Wife, ordered Husband to pay child support, suspended Husband’s child visitation, and issued a permanent restraining order protecting Wife and her parents from Husband.

In August 2000, Wife decided to seek dissolution of marriage and allowed Husband supervised visitation of the children despite earlier orders by the court.

Husband’s last visit and contact with the children occurred in February 2001 and in August 2001, Husband moved to Florida. In October 2004 and January 2006, the court denied Husband’s requests for modification of child support and visitation.

In May 2006, Wife sought termination of Husband’s parental rights and adoption of the children by their new stepfather. This request was granted by the court in November 2006 and reversed by an appellate court in October 2007.

In February 2008, Wife again sought termination of Husband’s parental rights alleging that Husband abandoned the children within the meaning of Family Code Section 7822 because he had not visited them since March 2001 and had “economically and emotionally abandoned [them].” Both sides were heard in November 2008 and March 2009 and the family court concluded that Husband’s evidence were not credible. Husband claimed that he did not pay $336,648.02 in child support arrearages because he was broke but his tax returns indicated income of over $77,000 and he was the owner of a successful welding equipment business.

The court also found that Husband had abandoned the children within the meaning of Family Code Section 7822 because he left the children in Wife’s care in early 2001for more than one year without any provision for support or communication. The intent to abandon was shown in his failure to support and communicate with the children. The court found that parental rights termination was in the best interest of the children, noting that “pounding your chest and saying you want to see your children is not the same as taking steps to do it.”

What is The Universal Declaration of Human Rights?-Know Your Rights.

Do you know your rights under your constitution of the nation? Have you ever evaluated your rights? If not, how you will follow the legal course to address the problems arising? Very few countries are serious about promoting the right to education for people to help you know your rights. Have you tried to know that the right to good food and the right to basic education is covered in your Universal Declaration of Human Rights? Being a student of the Post-Graduate Diploma in Human Rights, have attempted to know your rights?

On December 10, 1948, the United Nations General Assembly adopted and proclaimed the Universal Declaration of Human Rights. It aims to promote respect for these rights and freedoms and their universal recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction. It is applicable to all UN member states, which are now almost all countries of the world. The Universal Declaration of Human Rights was not originally designed to be legally binding, but it became legally binding as customary law of the individual man. It lists the rights of your human beings in the world, called articles 30.

1 You are born free and equal and should act towards one another in a spirit of brotherhood
2 You can not be discriminated against based on race, color, sex, language, religion, political or social origin.
3 You have the universal right to life, liberty and security.
4 You can not be held in slavery and the slave trade shall be prohibited in all their forms
5 You can not be subjected to torture or inhuman or degrading treatment in all countries.
6 Your rights are equal as a person before the law in all countries
7 You are entitled to equal protection against any discrimination in violation of this Declaration of Human Rights.
8. The universal human rights for all individuals are protected by the law of the country.
9 You can not be arbitrarily arrested, detained or exiled to a country.
10. You have the universal right to trial by an impartial tribunal means any criminal charge against you.
11. You have the universal right to continue innocent until proven guilty by a fair trial under the law in all countries.
12. You have the right to privacy protected by the law of the Member States.
13. You have the right to freedom of movement and residence within the borders of your country.
14 All individuals under persecution have the right to seek asylum in other countries as a safe place to live.
15. You can not be arbitrarily deprived of his nationality nor denied the right to change nationality
16. All men and women of marriageable age have the same rights to marry and grow a family.
17. You have the right to own property alone as well as in association with others.
18. You have the right to freedom of thought, conscience and the right to religion.
19. You have the right to freedom of opinion and expression
20. You have the right to freedom of peaceful assembly and association
21. You have the right to Democracy
22. You have the right to social security.
23. You have the right to work, to free choice of employment and reasonable working conditions.
24. You have the right to rest and leisure
25. You have the universal right to adequate food and shelter.
26. You have the universal right to education. Education shall be free, at least in the elementary and fundamental
27. You have the right to participate in the cultural life of the community and the right to protection of moral and material interests.
28. You have the universal right to a fair trial and Free World
29. You have the right responsibility
30. All machines in the United Nations and Member States and their various acts of the judiciary is intended to work in the target set in the Universal Declaration of Human Rights, 1948.

Do you know how many people in the world are entitled to these rights? Do you know how those rights are accepted by the law of your country? Most UN member states have completed the paper required to accept these rights and to punish those who violate it. But the practical spirit is lacking, even in developed countries. Do you know that the empowerment of social justice is missing in the world? Large companies are exploiting your rights and cause an imbalance in the distribution of wealth and pollution of the global environment. Do you know that good food and housing is still denied to most people in the world? Do you know that the right to basic education is still denied to children in the world? Many are not even aware of this right.

Have you tried to know that the right to good food and accommodation is included in your Universal Declaration of Human Rights? Have you ever tried to know that the right to basic education is covered in your Universal Declaration of Human Rights? Have you ever tried to know that freedom of expression is within your rights? Have you ever tried to know that the right to freedom of thought, conscience and religion is included in your rights universal? Have you ever tried to know that you are fully aware and support the human rights of all human beings in the world? If human rights are followed with honesty, peace in human life in the world is already achieved? It is my perception
